1. Acceptance of Terms

By accessing or using AlphaLens ("the Service"), operated by AlphaLens Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AlphaLens is a portfolio analytics platform that provides tools for tracking, analyzing, and gaining insights into investment portfolios. The Service may include AI-powered analytics, market data, portfolio tracking, alerts, and other features.

3. NOT FINANCIAL ADVICE

THE SERVICE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. Nothing on AlphaLens constitutes financial advice, investment advice, trading advice, or any other form of professional advice.

AlphaLens is not a registered investment advisor, broker-dealer, or financial planner. We do not act as a fiduciary to any user. No fiduciary relationship is created by your use of the Service.

Any analytics, insights, recommendations, scores, ratings, or projections provided by the Service — including those generated by artificial intelligence — are not recommendations to buy, sell, or hold any security. They should not be relied upon as the sole basis for any investment decision.

You should always consult with a qualified financial advisor before making any investment decisions. Past performance does not guarantee future results.

4. AI-Generated Content Disclaimer

AlphaLens uses artificial intelligence and machine learning technologies to generate analytics, insights, and content. AI-generated information may be:

  • Inaccurate or incomplete — AI models can produce errors, hallucinations, or outdated information
  • Not real-time — Data may be delayed; do not use for time-sensitive trading decisions
  • Not personalized financial advice — AI outputs do not account for your individual financial situation, risk tolerance, or investment objectives
  • Subject to change — AI models are continuously updated and may produce different results over time

You acknowledge and agree that any reliance on AI-generated content is at your own risk.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHALENS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any financial losses, investment losses, or damages arising from your use of the Service
  • Any decisions made based on information, analytics, or recommendations provided by the Service
  • Any inaccuracies, errors, or omissions in the data, analytics, or AI-generated content
  • Any interruptions, delays, or failures in the Service
  • Any unauthorized access to or alteration of your data
  • Any indirect, incidental, special, consequential, or punitive damages

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

6. Assumption of Risk

Investing in securities involves risk, including the potential loss of principal. You acknowledge that you are solely responsible for your own investment decisions and that AlphaLens bears no responsibility for any outcomes resulting from actions you take based on the Service. You use the Service at your own risk.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service. You agree to provide accurate and complete information when creating your account.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Scrape, data mine, or automatically collect data from the Service
  • Resell, redistribute, or commercially exploit the Service without authorization
  • Interfere with or disrupt the Service or its infrastructure

9. Data Accuracy

While we strive to provide accurate market data and analytics, we do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service. Market data may be delayed and is sourced from third-party providers. We are not responsible for errors in third-party data.

10. Intellectual Property

The Service, including its design, features, code, and content, is owned by AlphaLens and protected by intellectual property laws. You retain ownership of any data you input into the Service (such as portfolio holdings). We do not claim ownership of your personal financial data.

11. Subscription and Billing

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, with cancellation effective at the end of the current billing period. Refunds are not provided for partial billing periods.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

13. Indemnification

You agree to indemnify and hold harmless AlphaLens and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
